This Abuse Reporting Policy ("Policy") establishes the framework under which Apex Thunder may receive, assess, review, and, where deemed appropriate, respond to reports of suspected abuse involving our Services. It describes the types of activity that may be reviewed, the information generally required to evaluate a report, and the actions that may be taken at Apex Thunder's sole discretion. This Policy forms part of our Terms of Service and applies to all Customers, users, visitors, complainants, third parties, and any person or entity interacting with Apex Thunder Services.

Purpose of This Policy

Apex Thunder is committed to maintaining the security, stability, integrity, and lawful operation of its Services. This Policy provides a structured process for submitting reports of suspected abuse while allowing Apex Thunder to evaluate available information, protect its infrastructure, comply with applicable legal obligations, and determine appropriate operational responses based on the circumstances of each matter.

Reports may relate to activities including, but not limited to, spam, phishing, malware, network abuse, fraud, illegal content, intellectual property claims, security incidents, violations of our Acceptable Use Policy or Terms of Service, or other conduct that may threaten our Services, Customers, infrastructure, or third parties. The submission of a report does not obligate Apex Thunder to investigate, take enforcement action, provide updates, or reach any particular outcome.

Our Review Principles

Apex Thunder reviews abuse reports using information that we consider relevant and reasonably available, including technical evidence, contractual obligations, applicable law, internal security procedures, and other operational considerations. Allegations alone do not establish liability or wrongdoing, and no action will be based solely on unsupported claims where additional verification is reasonably required.

We may, at our sole discretion, request additional information, preserve logs or other records, limit or suspend Services while a matter is being assessed where appropriate, communicate with affected parties, or cooperate with service providers and competent authorities where legally required or where we reasonably determine such cooperation to be necessary for security, legal compliance, or the protection of our Services.

Scope of This Policy

This Policy applies to all products, Services, systems, platforms, websites, Customer accounts, applications, APIs, domain-related Services, email services, DNS services, storage, backups, networks, infrastructure, and any other resources owned, operated, managed, or provided by Apex Thunder. This Policy supplements, and does not replace, any applicable contractual terms, legal requirements, or other published Apex Thunder policies.

Abuse Covered by This Policy

Abuse reports may include, without limitation, spam, phishing, malware distribution, botnet activity, denial-of-service attacks, unauthorized access attempts, fraud, scams, abusive email activity, illegal or prohibited content, copyright or trademark complaints, child safety concerns, security incidents, policy violations, or any other activity that may violate applicable law or Apex Thunder's published policies. Apex Thunder reserves the right to determine, in its sole discretion, whether reported conduct falls within the scope of this Policy and whether any response is appropriate under the circumstances.

1. Introduction & Policy Overview

Apex Thunder is committed to maintaining a secure, stable, and legally compliant hosting environment. This Abuse Reporting Policy establishes the framework under which Apex Thunder may receive, assess, review, and, where deemed appropriate, respond to reports of suspected abusive, malicious, unlawful, or prohibited activity involving our Services. This Policy applies to Customers, users, complainants, security researchers, network operators, rights holders, governmental authorities, and any other party interacting with Apex Thunder Services. Nothing in this Policy shall be interpreted as creating an obligation for Apex Thunder to investigate every report, take any specific action, or reach any particular outcome.

1.1 Purpose of This Policy

The purpose of this Policy is to provide a structured process for submitting reports of suspected abuse involving Apex Thunder Services while enabling Apex Thunder to evaluate available information, protect its infrastructure, comply with applicable legal obligations, and determine appropriate operational or administrative responses based on the facts and circumstances of each matter. Submission of an abuse report does not guarantee that an investigation will be initiated, that enforcement action will be taken, or that the reporting party will receive updates regarding the outcome.

1.2 Scope

This Policy applies to all Services, systems, platforms, Customer accounts, websites, applications, APIs, Shared Hosting, WordPress Hosting, Managed WordPress Hosting, Cloud VPS Hosting, Dedicated Servers, domain-related Services, email services, DNS services, storage, backups, networks, and any other products, infrastructure, or resources owned, operated, managed, or provided by Apex Thunder. This Policy supplements, and does not replace, our Terms of Service, Acceptable Use Policy, Privacy Policy, or any other applicable agreement or published policy.

1.3 Types of Abuse Covered

Reports governed by this Policy may include, without limitation, spam, phishing, malware distribution, botnet activity, denial-of-service attacks, unauthorized access attempts, hacking, fraud, scams, abusive email activity, network abuse, copyright or trademark complaints, illegal or prohibited content, child safety concerns, security incidents, violations of the Acceptable Use Policy, violations of the Terms of Service, or any other activity that may violate applicable law or Apex Thunder's published policies. Apex Thunder reserves the sole right to determine whether reported conduct falls within the scope of this Policy.

1.4 Review Principles

Apex Thunder reviews abuse reports using information that it considers relevant and reasonably available, including technical evidence, system records, contractual obligations, applicable legal requirements, internal security procedures, and other operational considerations. Allegations alone do not establish liability or wrongdoing, and Apex Thunder may decline to proceed where available information is insufficient, unreliable, unverifiable, or otherwise inadequate to support further review.

1.5 Reservation of Rights

Apex Thunder reserves the right, at its sole discretion and without obligation, to request additional information, preserve logs or other records, communicate with Customers, complainants, service providers, registrars, upstream providers, or competent authorities where legally required or otherwise deemed appropriate, temporarily restrict Services, suspend or terminate accounts, reject or close incomplete, duplicative, abusive, or unsupported reports, or take no action where Apex Thunder determines that no action is warranted. Any decision made under this Policy shall be final unless Apex Thunder elects, in its sole discretion, to reconsider the matter. Failure or delay by Apex Thunder to exercise any right or remedy under this Policy shall not constitute a waiver of that right or any other right available under applicable agreements or law.

2. Reporting Abuse

Apex Thunder may accept abuse reports from Customers, Internet users, security researchers, network operators, service providers, intellectual property rights holders, governmental authorities, law enforcement agencies, and other parties acting in good faith. Reports should contain sufficient factual and technical information to permit an initial assessment of the reported activity. Submission of a report does not obligate Apex Thunder to investigate, respond, communicate with the reporting party, or take any particular enforcement action.

2.1 Who May Submit an Abuse Report

Abuse reports may be submitted by any individual or organization that reasonably believes Apex Thunder Services are being used in a manner that may violate applicable law, our Terms of Service, Acceptable Use Policy, this Policy, or other applicable legal or contractual requirements. Apex Thunder may, at its sole discretion, require verification of the reporter's identity, authority, or supporting documentation before reviewing or acting upon any report.

2.2 Good-Faith Reporting

Abuse reports should be submitted honestly, accurately, and in good faith based upon information reasonably believed to be true. Reports that appear to be knowingly false, misleading, incomplete, malicious, abusive, speculative, intended to harass, gain a competitive advantage, interfere with another party's business, or otherwise misuse this reporting process may be rejected without further review and may result in additional action where permitted by applicable law or our policies.

2.3 Preferred Reporting Channels

Abuse reports should be submitted through Apex Thunder's designated Abuse, Security, Legal, or Support communication channels, as appropriate. Apex Thunder may decline to review reports submitted through unofficial, unauthorized, incomplete, or unverifiable channels and assumes no responsibility for delays, loss of information, or failure of delivery associated with third-party communication methods.

2.4 Information Required

To facilitate review, reports should include, where available, the affected domain name, IP address, URL, email address, account identifier, timestamps, relevant log entries, message headers, screenshots, technical evidence, and a clear factual description of the reported activity. Apex Thunder may request additional information or supporting evidence and may decline to proceed where the information provided is insufficient, unreliable, unverifiable, or otherwise inadequate for assessment.

2.5 Anonymous Reports

Apex Thunder may, but is under no obligation to, review anonymous reports where sufficient technical evidence is available. Anonymous submissions may limit our ability to verify information, request clarification, communicate with the reporting party, or conduct further review, and may therefore be closed without further action at our sole discretion.

2.6 Multiple or Duplicate Reports

Apex Thunder may consolidate multiple reports relating to the same incident, Customer, Service, IP address, domain, or underlying activity into a single internal case. Duplicate or repetitive submissions do not receive priority, do not accelerate any review process, and may be closed or merged without separate responses.

2.7 No Action or Response Guarantee

Submission of an abuse report does not create any obligation for Apex Thunder to initiate an investigation, suspend, restrict, remove, or terminate any Service or Customer account, disclose investigative findings, provide status updates, or communicate the outcome of any review. Any action, inaction, enforcement measure, or decision under this Policy shall be made solely at Apex Thunder's discretion after consideration of the information available and any applicable legal, contractual, operational, or security requirements.

3. Types of Abuse We May Review

Apex Thunder may review reports involving activities that could affect the security, stability, availability, integrity, reputation, or lawful operation of our Services, infrastructure, Customers, or the wider Internet ecosystem. The categories below are provided for illustrative purposes only and are not exhaustive. Apex Thunder reserves the sole and absolute discretion to determine whether reported conduct falls within the scope of this Policy and whether any review or action is appropriate under the circumstances.

3.1 Network & Infrastructure Abuse

Reports may include, without limitation, denial-of-service (DoS/DDoS) attacks, distributed attacks, port scanning, unauthorized vulnerability scanning, brute-force attempts, network flooding, packet spoofing, routing abuse, protocol abuse, amplification attacks, bandwidth abuse, IP reputation abuse, or other activities that may adversely affect networks, infrastructure, or service availability.

3.2 Email & Messaging Abuse

Reports may relate to unsolicited bulk email (spam), phishing campaigns, email spoofing, malicious or deceptive email activity, fraudulent communications, abuse of mail services, compromised mail accounts, unsolicited marketing messages, malicious mailing lists, or other forms of abusive electronic messaging.

3.3 Security Incidents

Security-related reports may include unauthorized access attempts, credential theft, account compromise, malware distribution, ransomware, spyware, trojans, botnet activity, command-and-control infrastructure, malicious scripts, cryptojacking, exploitation of software vulnerabilities, or other activities intended to compromise systems, networks, Services, or data.

3.4 Illegal or Harmful Content

Reports may concern websites, applications, files, or other content that allegedly violates applicable law, facilitates fraud, phishing, scams, counterfeit operations, malicious downloads, child safety requirements, or other content prohibited under Apex Thunder's published policies. Apex Thunder does not independently verify the legality of all reported content and may rely upon available evidence, applicable law, or competent legal authority when determining whether any action is appropriate.

3.5 Intellectual Property Complaints

Reports involving alleged copyright infringement, trademark disputes, or other intellectual property matters may be handled in accordance with this Policy, our separate DMCA / Copyright Infringement Policy, or any other applicable legal process. Submission of such a report does not guarantee removal of content or any particular enforcement action.

3.6 Policy Violations

Apex Thunder may review reports alleging violations of its Terms of Service, Acceptable Use Policy, Privacy Policy, Support Policy, Refund & Cancellation Policy, Security Policy, or any other applicable agreement or published policy, regardless of whether the reported conduct also constitutes a violation of applicable law.

3.7 Other Activities

Apex Thunder reserves the right, but assumes no obligation, to review any other reported activity that it reasonably believes may affect the security, reliability, legal compliance, reputation, operational integrity, Customers, infrastructure, or legitimate business interests of Apex Thunder or third parties. The omission of any specific activity from this Policy shall not limit Apex Thunder's authority to review or respond to matters at its sole discretion.

4. Required Information for Abuse Reports

To facilitate an initial assessment of a reported matter, Apex Thunder may require sufficient factual and technical information to reasonably identify the reported activity. Reports that contain clear, relevant, and verifiable information are generally easier to assess; however, the submission of complete information does not obligate Apex Thunder to investigate, respond, or take any particular action. Reports that are incomplete, unsupported, unverifiable, or otherwise insufficient may be declined, closed, or receive no further review at our sole discretion.

4.1 Identification of the Reported Resource

Reports should identify the affected resource with sufficient specificity, including, where applicable, the domain name, subdomain, IP address, URL, email address, hostname, server identifier, Customer account, virtual server, dedicated server, or any other information reasonably necessary to identify the reported Service or activity.

4.2 Description of the Incident

Reports should include a clear and factual description of the alleged activity, including the nature of the incident, when it occurred, how it was identified, and the basis for believing that the reported activity may violate applicable law, Apex Thunder's published policies, or applicable contractual obligations.

4.3 Supporting Evidence

Where reasonably available, supporting evidence may include screenshots, server logs, message headers, email samples, timestamps, URLs, network captures, malware samples, security alerts, or other relevant technical information. Apex Thunder reserves the right to determine the relevance, authenticity, reliability, and evidentiary value of any materials submitted and may disregard information it considers incomplete, unverifiable, unreliable, or otherwise insufficient.

4.4 Reporter Information

Reporters may be requested to provide accurate contact information, including their name, organization (where applicable), and a valid email address. Apex Thunder may use this information to request clarification, verify supporting evidence, confirm authority to submit the report, or communicate with the reporting party where it determines such communication to be appropriate. Apex Thunder is under no obligation to provide status updates or disclose the outcome of any review.

4.5 Accuracy of Information

Individuals submitting reports represent that, to the best of their knowledge, the information provided is accurate and submitted in good faith. Knowingly providing false, misleading, fabricated, altered, fraudulent, or intentionally incomplete information may result in the report being rejected or closed without further review and may lead to additional action where permitted by applicable law or Apex Thunder's published policies.

4.6 Requests for Additional Information

Apex Thunder may, but is under no obligation to, request additional documentation, technical evidence, proof of authority, identity verification, or any other information it reasonably considers relevant to its assessment. Failure or refusal to provide requested information may result in the report being closed, declined, or reviewed solely on the information already available.

4.7 Incomplete or Unverifiable Reports

Reports that lack sufficient information, cannot reasonably identify the reported activity, contain inconsistent or contradictory information, rely solely on unsupported allegations, or cannot be reasonably verified may be declined, deferred, merged with other reports, or closed without further action at Apex Thunder's sole and absolute discretion. Apex Thunder assumes no responsibility for any consequences arising from its decision not to review or act upon any report.

5. Investigation & Review Process

Apex Thunder may review abuse reports using the information reasonably available at the time of assessment. Any review conducted under this Policy is performed solely for Apex Thunder's operational, security, contractual, and legal purposes. Nothing in this Policy creates an obligation to investigate every report, continue an investigation once initiated, disclose investigative activities, communicate with any reporting party, or reach any particular conclusion or outcome.

5.1 Initial Review

Upon receipt of an abuse report, Apex Thunder may conduct an initial assessment to determine whether sufficient information is available to proceed with further review. Reports may be accepted, declined, deferred, merged with related reports, or closed at any stage based upon available information, operational priorities, applicable legal requirements, security considerations, or any other factor deemed relevant by Apex Thunder.

5.2 Technical Review

Where Apex Thunder determines it to be appropriate, we may examine server logs, authentication records, network activity, DNS data, email headers, timestamps, account activity, IP assignment records, virtualization records, configuration information, publicly available information, or other technical data reasonably relevant to the reported matter. Apex Thunder reserves the right to determine what information, if any, will be reviewed.

5.3 Requests for Additional Information

Apex Thunder may, but is under no obligation to, request additional information from the reporting party, the affected Customer, upstream providers, data center operators, registrars, Internet service providers, security researchers, rights holders, governmental authorities, law enforcement agencies, or other relevant parties. Failure by any party to provide requested information may affect the scope of review or result in the matter being closed without further action.

5.4 Preservation of Information

Apex Thunder may preserve logs, account records, communications, system metadata, configuration information, network records, backups, forensic data, or other information for operational, security, contractual, compliance, evidentiary, or legal purposes where permitted or required by applicable law. Preservation of information does not imply that a violation has occurred or that enforcement action will be taken.

5.5 Interim Protective Measures

Where Apex Thunder reasonably determines that immediate action may be necessary to protect its infrastructure, Customers, third parties, or the security and stability of its Services, it may implement temporary protective measures, including traffic filtering, temporary restrictions, account verification requirements, content limitations, Service suspension, network controls, or other safeguards, with or without prior notice where permitted by applicable agreements or law.

5.6 Review Timeframes

Review and investigation timeframes vary depending upon the nature of the reported matter, available evidence, cooperation from relevant parties, operational workload, legal requirements, security priorities, and other circumstances. Apex Thunder makes no representation or warranty regarding review, response, or resolution times except where expressly required by applicable law or a separate written agreement.

5.7 Possible Outcomes

Following its review, Apex Thunder may determine, in its sole discretion, to take no action, request additional information, request corrective action from a Customer, restrict or remove content, temporarily or permanently suspend Services, terminate accounts, preserve evidence, refer the matter to an upstream provider or competent authority, or take any other action permitted under applicable agreements, published policies, or law. Apex Thunder is not obligated to disclose the basis for any decision or the outcome of any internal review.

5.8 Sole Discretion

Apex Thunder retains the exclusive and absolute discretion to determine the scope, priority, methodology, duration, findings, and outcome of any review conducted under this Policy. Apex Thunder may suspend, resume, reopen, limit, or discontinue any review at any time and for any reason without liability. No provision of this Policy shall be interpreted as creating any duty of care, contractual obligation, or enforceable right in favor of any reporting party, Customer, or third party except to the extent expressly required by applicable law.

6. Actions We May Take

Following the assessment of any abuse report, Apex Thunder may, in its sole and absolute discretion, determine that no action is appropriate or may implement one or more operational, administrative, technical, contractual, or legal measures. Any action taken under this Policy shall depend upon the information available, the severity of the reported matter, applicable agreements, operational requirements, security considerations, legal obligations, and other factors deemed relevant by Apex Thunder. The measures described below are illustrative only and do not limit Apex Thunder's authority to take any other lawful action.

6.1 No Action

Apex Thunder may determine that no action is appropriate where available information does not reasonably support the reported allegations, where the reported activity does not violate applicable agreements or law, where evidence is insufficient or unverifiable, or where Apex Thunder otherwise determines that no further action is warranted. The decision not to take action does not constitute approval, endorsement, or validation of the reported activity.

6.2 Warning or Corrective Measures

Apex Thunder may, but is under no obligation to, issue warnings, request additional information, require corrective measures, request removal of reported content, require security remediation, require software updates or configuration changes, request verification of account ownership, or require any other corrective action that Apex Thunder considers appropriate.

6.3 Temporary Restrictions

Apex Thunder may temporarily restrict or limit access to Services, websites, applications, email functionality, DNS services, APIs, administrative access, network connectivity, outbound traffic, account functionality, or any other platform feature where it reasonably determines such measures are appropriate for operational, security, legal, or compliance purposes.

6.4 Content Restriction or Service Suspension

Apex Thunder may disable, restrict, quarantine, remove, or otherwise limit access to content, Services, Customer accounts, virtual servers, dedicated servers, websites, applications, or other hosted resources where it reasonably determines that such action is appropriate under its agreements, published policies, operational requirements, or applicable law. Such action may be taken with or without prior notice where permitted by applicable agreements or law.

6.5 Immediate Protective Action

Where Apex Thunder reasonably believes that a reported matter may present an immediate or significant risk to its infrastructure, Customers, third parties, legal compliance, or the security or stability of its Services, Apex Thunder may immediately implement protective measures, including account restrictions, Service suspension, network isolation, traffic filtering, content restriction, credential invalidation, emergency administrative controls, or any other measure deemed appropriate, with or without prior notice.

6.6 Account Suspension or Termination

Apex Thunder may suspend or permanently terminate any Customer account or Service where it determines, in its sole discretion, that continued operation presents unacceptable operational, contractual, legal, financial, reputational, or security risks, or where the Customer has engaged in repeated abuse, material policy violations, unlawful conduct, fraudulent activity, refusal to cooperate, or any other material breach of applicable agreements.

6.7 Cooperation with Third Parties

Apex Thunder may cooperate with upstream providers, data center operators, registrars, registry operators, payment processors, Internet service providers, security organizations, governmental authorities, judicial authorities, law enforcement agencies, or other competent parties where required by applicable law or where Apex Thunder reasonably determines that such cooperation is appropriate for operational, contractual, legal, security, fraud prevention, or compliance purposes.

6.8 Preservation of Information

Apex Thunder may preserve logs, communications, account records, technical information, forensic data, metadata, backups, billing records, or other information for operational, contractual, evidentiary, legal, compliance, fraud prevention, or security purposes, subject to applicable law and our published policies. Preservation of information does not imply that any violation has occurred or that enforcement action will necessarily follow.

6.9 Fees, Billing & Refunds

Any restriction, suspension, limitation, or termination of Services arising from activities addressed under this Policy shall be governed by the applicable Terms of Service, Refund & Cancellation Policy, and other governing agreements. Unless expressly required by applicable law or expressly approved in writing by Apex Thunder, Customers shall not be entitled to refunds, credits, compensation, or cancellation of outstanding payment obligations as a result of enforcement actions taken under this Policy.

6.10 Reservation of Rights

Apex Thunder retains the sole, exclusive, and absolute discretion to determine whether reported conduct constitutes abuse, whether any review will be conducted, what action, if any, will be taken, the timing of such action, and whether additional measures are appropriate. Nothing contained in this Policy limits Apex Thunder's right to take any lawful action, decline to take action, discontinue any review, or exercise any contractual or legal remedy available under applicable agreements or law.

7. False, Malicious & Fraudulent Reports

Apex Thunder expects all abuse reports to be submitted honestly, accurately, and in good faith. Our abuse reporting mechanisms are provided solely for the purpose of reporting legitimate security, legal, policy, or operational concerns and must not be used to harass, intimidate, disrupt legitimate Services, obtain a competitive advantage, interfere with lawful activities, or otherwise misuse our reporting process. Apex Thunder reserves the right to reject, disregard, limit, or discontinue the review of any report that it reasonably determines to be abusive, fraudulent, misleading, or submitted in bad faith.

7.1 Good-Faith Reporting

Individuals submitting abuse reports represent that, to the best of their knowledge, the information provided is accurate, complete, and submitted in good faith based upon a reasonable belief that the reported activity may violate applicable law, Apex Thunder's Terms of Service, Acceptable Use Policy, or other applicable agreements or published policies.

7.2 False or Misleading Reports

Apex Thunder may reject, disregard, close, or decline to review reports containing information that appears false, misleading, fabricated, altered, contradictory, intentionally incomplete, unverifiable, or otherwise unreliable. Apex Thunder may request additional supporting information but is under no obligation to do so before determining whether further review is appropriate.

7.3 Misuse of the Reporting Process

Abuse reporting mechanisms must not be used to harass Customers or third parties, interfere with legitimate business activities, retaliate against competitors, pursue private disputes unrelated to abuse, generate unnecessary operational workload, or otherwise misuse Apex Thunder's reporting procedures. Apex Thunder may reject such reports without further review and may take any action permitted under applicable agreements or law.

7.4 Verification

Apex Thunder may, at its sole discretion, verify the identity or authority of a reporting party, request additional technical information or supporting documentation, seek clarification, perform independent analysis, or rely upon information available from internal or external sources before determining whether any review or action is appropriate.

7.5 Repetitive or Abusive Submissions

Apex Thunder may consolidate, deprioritize, reject, limit, or discontinue the processing of repetitive, duplicative, frivolous, malicious, abusive, or bad-faith submissions. Apex Thunder is under no obligation to acknowledge, respond to, or continue reviewing reports from any individual or organization that repeatedly misuses the reporting process.

7.6 Record Retention

Apex Thunder may retain abuse reports, supporting materials, communications, technical information, internal notes, metadata, and related records for operational, security, contractual, evidentiary, fraud prevention, audit, compliance, or legal purposes, subject to applicable law and our published policies.

7.7 Cooperation with Third Parties

Where required by applicable law or where Apex Thunder reasonably determines that cooperation is appropriate, we may share relevant information with competent governmental authorities, law enforcement agencies, judicial authorities, upstream providers, registrars, registry operators, data center providers, payment processors, security organizations, or other appropriate parties in connection with fraudulent reporting, abuse of this Policy, or other unlawful conduct.

7.8 Reservation of Rights

Apex Thunder retains the sole and absolute discretion to determine whether any abuse report will be accepted, reviewed, investigated, or acted upon. We may reject, suspend, discontinue, or close any report, with or without explanation, where we determine that further review is unwarranted or inconsistent with our operational, contractual, legal, or security interests. Nothing in this Policy creates any right or expectation that Apex Thunder will investigate, respond to, or take action regarding any particular report.

8. Customer Responsibilities

Customers are responsible for ensuring that their use of Apex Thunder Services complies with applicable law, our Terms of Service, Acceptable Use Policy, and all other applicable agreements and published policies. Customers are solely responsible for the operation, administration, security, and content of the Services they use. Nothing in this Policy limits or transfers those responsibilities to Apex Thunder.

8.1 Account Security

Customers are solely responsible for maintaining the security and confidentiality of their accounts, authentication credentials, control panels, servers, websites, applications, APIs, databases, email accounts, devices, and any other resources under their control. Unauthorized access, account compromise, credential theft, or misuse of Customer resources does not relieve the Customer of responsibilities under applicable agreements and does not create liability for Apex Thunder.

8.2 Monitoring Customer Services

Customers are responsible for monitoring and managing their own Services, including identifying unauthorized access, compromised applications, malware, spam, phishing, excessive resource usage, security vulnerabilities, or other indicators of abuse. Apex Thunder does not undertake continuous monitoring of Customer content, systems, or activities and assumes no obligation to detect or prevent abuse on behalf of Customers.

8.3 Cooperation During Reviews

Where Apex Thunder requests information or corrective action in connection with a reported matter, Customers are expected to respond within any reasonable timeframe specified by Apex Thunder. Failure to respond, refusal to cooperate, or the provision of incomplete or misleading information may result in Apex Thunder limiting, suspending, or terminating affected Services or taking any other action permitted under applicable agreements or law.

8.4 Corrective Measures

Customers may be required to remove reported content, secure compromised systems, update vulnerable software, disable abusive services, rotate credentials, implement security controls, or take other corrective measures where Apex Thunder reasonably determines such action to be appropriate. Apex Thunder reserves the right to determine whether corrective measures are adequate and whether additional action is necessary.

8.5 Responsibility for Authorized Users

Customers remain fully responsible for all actions performed through their accounts or Services by employees, administrators, contractors, developers, resellers, affiliates, authorized users, or any other individual or entity granted access by or through the Customer, regardless of whether such activity was specifically authorized by the Customer at the time it occurred.

8.6 Third-Party Software and Content

Customers are solely responsible for all third-party software, scripts, plugins, themes, templates, operating systems, control panels, APIs, applications, content, and other components installed, uploaded, configured, licensed, or operated within their Services. Apex Thunder does not warrant, monitor, audit, or assume responsibility for the security, legality, functionality, or maintenance of any third-party component.

8.7 Failure to Cooperate

If a Customer fails to cooperate, refuses to provide requested information, fails to implement requested corrective measures, or continues activities that Apex Thunder reasonably believes present operational, contractual, legal, or security concerns, Apex Thunder may, at its sole discretion and without liability, restrict, suspend, terminate, or otherwise limit affected Services in accordance with applicable agreements and law.

8.8 Continuing Obligations

Customer obligations relating to security, legal compliance, cooperation, payment obligations, record preservation, indemnification, and other applicable contractual responsibilities shall survive suspension or termination of Services to the extent permitted by applicable law and the governing agreements between the Customer and Apex Thunder.

9. Third-Party Requests & Cooperation

Apex Thunder may receive abuse reports, security notifications, legal requests, operational communications, or other inquiries from third parties concerning Services hosted on or associated with our infrastructure. Apex Thunder may review such communications and determine, in its sole and absolute discretion, whether any response, investigation, disclosure, or operational action is appropriate, subject to applicable law, contractual obligations, security considerations, and the information reasonably available at the time of review.

9.1 Communications from Infrastructure Providers

Notifications may originate from data center providers, upstream network providers, cloud infrastructure providers, Internet Exchange operators, registrars, registry operators, content delivery networks (CDNs), DNS providers, anti-spam organizations, threat intelligence providers, security vendors, payment processors, or other infrastructure or service partners. Apex Thunder may consider such information as part of its internal assessment but is under no obligation to adopt the conclusions or recommendations of any third party.

9.2 Governmental and Legal Requests

Apex Thunder may cooperate with governmental authorities, law enforcement agencies, judicial authorities, regulatory bodies, or other competent organizations where required by applicable law or where Apex Thunder reasonably determines that such cooperation is appropriate to protect its legal, operational, contractual, or security interests. Apex Thunder reserves the right to verify the validity, scope, and legal basis of any request before responding.

9.3 Security Researchers and Industry Organizations

Apex Thunder may review information submitted by Computer Security Incident Response Teams (CSIRTs), Computer Emergency Response Teams (CERTs), vulnerability disclosure programs, recognized security researchers, anti-malware organizations, threat intelligence providers, or other industry participants. Apex Thunder may independently determine the relevance, reliability, and evidentiary value of any information received.

9.4 Customer Cooperation

Apex Thunder may request information or assistance from Customers where reasonably necessary to assess a reported matter, including logs, configuration information, ownership records, licensing information, technical details, or other relevant documentation. Customers remain responsible for maintaining such information where required under applicable agreements. Failure to cooperate may result in actions permitted under this Policy, the Terms of Service, or applicable law.

9.5 Confidentiality of Reviews

Apex Thunder treats abuse reviews, internal investigations, security procedures, technical findings, communications, and related records as confidential except where disclosure is required by applicable law or otherwise determined by Apex Thunder to be appropriate. Apex Thunder is under no obligation to disclose investigative methods, internal analyses, Customer information, evidentiary materials, operational procedures, or the outcome of any review to any reporting party or third party.

9.6 Disclosure of Information

Apex Thunder may disclose information relating to an abuse report or investigation where permitted or required by applicable law, valid legal process, contractual obligations, or where Apex Thunder reasonably determines that disclosure is appropriate to protect its Services, Customers, infrastructure, personnel, partners, property, legal rights, or other legitimate interests. Any disclosure shall be limited to the extent Apex Thunder considers appropriate under the circumstances.

9.7 No Obligation to Act

Receipt of a report, notification, recommendation, request, or complaint from any third party does not require Apex Thunder to investigate, suspend Services, remove content, preserve information, disclose records, communicate with any party, or take any specific action. Apex Thunder retains sole and absolute discretion regarding whether and how any third-party communication will be addressed, except where otherwise required by applicable law.

9.8 Reservation of Rights

Apex Thunder reserves the right to communicate with Customers, infrastructure providers, registrars, registry operators, upstream providers, governmental authorities, legal representatives, security organizations, payment processors, or other relevant parties where it reasonably determines such communication to be appropriate. Apex Thunder may also decline requests, defer action, request additional information, discontinue communications, or close any matter without further action where available information is insufficient, unreliable, conflicting, or otherwise does not justify additional review.

10. Emergency & Law Enforcement Requests

Certain reports or incidents may require immediate operational attention due to potential risks affecting human safety, critical infrastructure, the security or stability of Apex Thunder Services, legal compliance, or other significant operational concerns. Apex Thunder reserves the sole and absolute discretion to determine whether a matter warrants emergency handling and to take any action it reasonably considers appropriate, subject to applicable law and contractual obligations.

10.1 Emergency Situations

Matters that may be treated as emergencies include, without limitation, credible threats to life or physical safety, active cyberattacks, ransomware incidents, malware outbreaks, botnet activity, large-scale phishing campaigns, child safety matters, terrorism-related investigations, significant fraud, attacks affecting critical infrastructure, or any other incident that Apex Thunder reasonably determines requires expedited operational or legal attention.

10.2 Priority Handling

Apex Thunder may prioritize emergency matters over routine reports based on the nature of the reported activity, potential impact, available evidence, legal obligations, operational considerations, security risks, and any other factors it considers relevant. Apex Thunder makes no representation regarding the order, timing, or completion of any review.

10.3 Immediate Protective Measures

Where Apex Thunder reasonably determines that immediate action is appropriate, it may, with or without prior notice where permitted by applicable law or agreement, restrict, suspend, isolate, filter, disable, or otherwise limit access to any Service, account, application, website, network resource, or other infrastructure in order to protect its Services, Customers, third parties, legal interests, or operational integrity.

10.4 Cooperation with Competent Authorities

Apex Thunder may cooperate with governmental authorities, law enforcement agencies, judicial authorities, regulatory bodies, Computer Security Incident Response Teams (CSIRTs), Computer Emergency Response Teams (CERTs), emergency response organizations, upstream providers, or other competent entities where required by applicable law or where Apex Thunder reasonably determines such cooperation to be appropriate. Apex Thunder reserves the right to verify the authenticity, scope, and legal basis of any request before responding.

10.5 Preservation of Information

Apex Thunder may preserve logs, account records, communications, network information, system metadata, forensic information, backups, technical records, or other relevant information for operational, security, evidentiary, contractual, compliance, or legal purposes where permitted or required by applicable law. Preservation of information does not imply that any violation has occurred or that enforcement action will necessarily follow.

10.6 Disclosure of Information

Apex Thunder may disclose information relating to emergency matters only where permitted or required by applicable law, valid legal process, contractual obligations, or where Apex Thunder reasonably determines that disclosure is appropriate to prevent imminent harm, protect human safety, preserve the security or integrity of its Services, or safeguard its legal or operational interests. Any disclosure shall be limited to the extent Apex Thunder considers appropriate under the circumstances.

10.7 Notice to Customers

Where Apex Thunder reasonably determines that immediate action is necessary or where notice is prohibited, restricted, or would compromise an investigation, security measures, or legal process, Apex Thunder may act without prior notice to the affected Customer. Any subsequent notification may be delayed, limited, or omitted to the extent permitted by applicable law or reasonably necessary to protect operational, legal, or security interests.

10.8 Reservation of Rights

Apex Thunder retains the sole and absolute discretion to determine whether any matter constitutes an emergency, establish response priorities, implement immediate protective measures, preserve information, cooperate with competent authorities, decline requests, discontinue communications, or take any other lawful action it considers appropriate. Nothing in this Policy creates any obligation to take emergency action or any enforceable right in favor of any Customer, reporting party, or third party except where expressly required by applicable law.

11. Limitation of Liability & Indemnification

Apex Thunder provides hosting and infrastructure services only and does not own, create, control, supervise, endorse, or assume responsibility for Customer Content, Customer activities, or third-party conduct. To the fullest extent permitted by applicable law, any liability arising from abuse reports, investigations, communications, operational decisions, or enforcement actions shall be limited by this Policy, our Terms of Service, and all other applicable agreements governing the Services.

11.1 Customer Responsibility

Customers remain solely and exclusively responsible for all content, websites, applications, servers, software, databases, email services, communications, data, configurations, activities, and other resources associated with their accounts or Services. Apex Thunder does not assume responsibility for Customer conduct, omissions, security practices, or compliance with applicable law and does not undertake any obligation to monitor, inspect, moderate, verify, or control Customer Content or activities except where expressly required by applicable law.

11.2 No Duty to Investigate or Enforce

Nothing in this Policy creates any duty or obligation requiring Apex Thunder to receive, investigate, continue reviewing, resolve, respond to, disclose information regarding, or take enforcement action in relation to any abuse report. Any review, communication, or enforcement measure is undertaken solely at Apex Thunder's discretion unless otherwise required by applicable law.

11.3 Decisions and Enforcement Actions

To the fullest extent permitted by applicable law, Apex Thunder shall not be liable for any decision, delay, refusal, omission, suspension, restriction, content limitation, preservation of information, disclosure, termination, communication, or other action or inaction undertaken in connection with this Policy, including actions taken to protect operational, contractual, legal, security, or business interests.

11.4 Third-Party Conduct

Apex Thunder shall not be responsible or liable for the acts, omissions, statements, recommendations, requests, decisions, services, or conduct of Customers, reporting parties, infrastructure providers, data centers, registrars, registry operators, upstream providers, payment processors, security vendors, Internet service providers, governmental authorities, judicial authorities, law enforcement agencies, or any other third party.

11.5 Service Availability

Operational, legal, compliance, security, maintenance, or abuse-related activities may temporarily affect the availability, accessibility, functionality, or performance of Services. Apex Thunder makes no representation or warranty that Services will remain uninterrupted or unaffected during such activities and shall not be liable for interruptions, delays, restrictions, degradation, or operational changes arising therefrom, except to the extent liability cannot be excluded under applicable law.

11.6 Exclusion of Certain Damages

To the fullest extent permitted by applicable law, Apex Thunder shall not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or similar damages, including without limitation loss of revenue, profits, income, business opportunities, contracts, goodwill, reputation, anticipated savings, data, use, productivity, or business interruption, whether arising in contract, tort, statute, equity, or otherwise, even if advised of the possibility of such damages.

11.7 Good-Faith Operational Actions

Apex Thunder shall not be liable for actions or omissions undertaken in good faith for operational, contractual, legal, compliance, fraud prevention, abuse mitigation, evidence preservation, network protection, security response, or other legitimate business purposes, including actions taken in reliance upon information reasonably believed to be accurate at the time.

11.8 Maximum Extent Permitted by Law

All exclusions, disclaimers, limitations of liability, and protections contained in this Policy shall apply to the maximum extent permitted by applicable law. If any provision is determined to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect, and the affected provision shall be interpreted or modified only to the minimum extent necessary to make it enforceable.

11.9 Indemnification

To the fullest extent permitted by applicable law, the Customer agrees to defend, indemnify, and hold harmless Apex Thunder, its affiliates, owners, officers, directors, employees, contractors, agents, licensors, successors, and service providers from and against any claims, demands, actions, proceedings, liabilities, judgments, fines, penalties, damages, losses, costs, and expenses, including reasonable legal fees and investigation costs, arising out of or relating to the Customer's use of the Services, Customer Content, Customer activities, violation of this Policy, breach of any applicable agreement, infringement of third-party rights, or violation of applicable law.

12. Changes to This Policy

Apex Thunder may amend, revise, supplement, replace, or discontinue this Abuse Reporting Policy at any time to reflect changes in applicable law, regulatory requirements, security practices, operational procedures, industry standards, business needs, or the Services we provide. The most current version published by Apex Thunder supersedes all previous versions unless expressly stated otherwise.

12.1 Right to Modify

Apex Thunder reserves the sole and absolute right to modify this Policy, in whole or in part, at any time and for any lawful reason. Modifications may include, without limitation, changes necessary to address legal or regulatory developments, emerging security threats, operational requirements, technological advancements, infrastructure changes, business practices, or clarification of existing provisions.

12.2 Effective Date

Unless expressly stated otherwise, revisions become effective on the Effective Date specified in the updated Policy. Continued access to or use of Apex Thunder Services after the Effective Date constitutes acceptance of the revised Policy to the fullest extent permitted by applicable law. If applicable law requires a different acceptance mechanism, Apex Thunder will comply with such requirements.

12.3 Customer Responsibility

Customers are responsible for reviewing this Policy periodically and remaining informed of the current version. Failure to review or become aware of updates does not limit the applicability of this Policy or relieve any Customer of obligations arising under applicable agreements or law.

12.4 Notice of Material Changes

Where required by applicable law, or where Apex Thunder determines that notice is appropriate, material changes may be communicated through the Client Area, our website, email, service announcements, or any other reasonable communication method selected by Apex Thunder. Apex Thunder is not obligated to provide individual notice of editorial, administrative, formatting, clarification, security, or other non-material revisions.

12.5 Relationship with Other Agreements

This Policy forms part of the Apex Thunder legal framework and should be read together with our Terms of Service, Acceptable Use Policy, Privacy Policy, DMCA & Copyright Policy, Support Policy, Refund & Cancellation Policy, and any other applicable policies or written agreements governing the Services. In the event of an express conflict between this Policy and a separately executed written agreement signed by Apex Thunder, that written agreement shall prevail solely with respect to the specific Services and provisions expressly covered by that agreement.

Will I receive updates about my report?

Apex Thunder may request additional information or acknowledge a report where appropriate. However, unless required by applicable law, we are under no obligation to provide investigation updates, disclose evidence, explain internal procedures, or communicate the outcome of any review or enforcement decision.

What happens if a report is false or submitted in bad faith?

Will a suspended Customer receive a refund?

Not necessarily. Eligibility for refunds, if any, is governed by the applicable Service agreement and the Apex Thunder Refund & Cancellation Policy. Enforcement actions under this Policy do not, by themselves, create any entitlement to refunds, compensation, or service credits.

Does this Policy apply to all Apex Thunder Services?

Yes. Unless expressly stated otherwise in a separate written agreement, this Policy applies to all Services and infrastructure provided or operated by Apex Thunder.
