This Acceptable Use Policy ("AUP") establishes the mandatory rules, standards, and restrictions governing access to and use of all websites, products, services, software, networks, infrastructure, platforms, and related offerings provided by Apex Thunder (collectively, the "Services"). This Policy forms an integral part of, and is incorporated by reference into, the Apex Thunder Terms of Service. Any actual or suspected violation of this Policy may constitute a violation of the Terms of Service and may result in enforcement actions determined by Apex Thunder in its sole discretion.

All Customers are solely responsible for ensuring that their use of the Services complies with this Policy, the Terms of Service, all applicable laws and regulations, and every policy published within the Apex Thunder Legal Center. Customers are also responsible for the actions, content, communications, software, configurations, and activities conducted through their accounts, whether performed by the Customer or by any authorized or unauthorized third party using the Customer's credentials, systems, or resources.

Apex Thunder reserves the unrestricted right, at its sole discretion and without obligation to provide prior notice, to interpret, apply, investigate, enforce, modify, or update this Policy, determine whether any conduct or activity violates or presents a risk under this Policy, and take any enforcement action it considers appropriate to protect its Services, Customers, personnel, infrastructure, business interests, or third parties.

Enforcement measures may include, without limitation, issuing warnings, removing or restricting content, suspending or terminating Services or accounts, blocking network activity, denying refunds, credits, or account reinstatement where permitted under the Terms of Service, preserving or disclosing relevant information when Apex Thunder reasonably believes it is appropriate or legally required, and cooperating with law enforcement or other competent authorities where applicable. Apex Thunder is not obligated to apply enforcement measures in any particular order or to provide advance notice before taking action.

1. Scope of This Policy

This Acceptable Use Policy applies to all Customers, Account Owners, users, authorized representatives, resellers, partners, and any person or entity accessing or using Apex Thunder Services. This Policy governs all use of the Services and is incorporated by reference into the Apex Thunder Terms of Service.

1.1 Services Covered

This Policy applies to all products, platforms, infrastructure, and Services provided by Apex Thunder, including but not limited to Shared Hosting, WordPress Hosting, Managed WordPress Hosting, Cloud VPS Hosting, Dedicated Servers, domain-related Services, email Services, DNS Services, website migration services, professional Services, software licenses, APIs, customer portals, and any future products or Services introduced by Apex Thunder, unless expressly excluded through a separate written agreement.

1.2 Persons Responsible

The Account Owner remains fully responsible for all activities conducted through their account, Services, resources, credentials, systems, or infrastructure, including activities performed by authorized users, employees, contractors, developers, customers, resellers, affiliates, API integrations, automated processes, or any other third party with access. The Account Owner may not avoid responsibility for any violation of this Policy by claiming that another person performed the activity.

1.3 Compliance with Laws

Customers are solely responsible for ensuring that their use of Apex Thunder Services complies with all laws, regulations, governmental requirements, court orders, sanctions, export controls, and other applicable legal obligations relevant to their activities, location, business operations, users, and target audiences. Apex Thunder does not provide legal advice and Customers remain solely responsible for determining the legal requirements applicable to their use of the Services.

1.4 Compliance with Apex Thunder Policies

Customers must comply with this Acceptable Use Policy, the Apex Thunder Terms of Service, Privacy Policy, Refund & Cancellation Policy, and all applicable service-specific requirements, technical limitations, security requirements, and other policies published within the Apex Thunder Legal Center. Any failure to comply may constitute a breach of the Terms of Service and may result in enforcement actions at Apex Thunder's sole discretion.

1.5 Customer Responsibility

Customers are solely responsible for maintaining the security, configuration, and proper operation of their accounts, credentials, applications, websites, servers, databases, scripts, integrations, and hosted content. Customers must implement reasonable security practices to prevent unauthorized access, compromise, misuse, malware infections, vulnerabilities, or abuse originating from their Services.

Apex Thunder is not responsible for security failures, data loss, unauthorized access, vulnerabilities, compromises, or damages resulting from Customer-controlled systems, software, configurations, credentials, negligence, improper maintenance, or failure to implement appropriate security measures.

2. Illegal Activities

Apex Thunder Services must not be used for activities that violate, facilitate the violation of, or create a reasonable risk of violating applicable laws, regulations, sanctions, governmental requirements, or third-party legal obligations. Customers are solely responsible for ensuring that their use of the Services complies with all applicable legal requirements.

2.1 Prohibited Illegal Activities

Customers may not use, attempt to use, facilitate, assist, promote, or permit the use of Apex Thunder Services for any unlawful purpose, including, but not limited to:

  • Fraud, financial fraud, payment fraud, chargeback abuse, identity theft, or deceptive financial activities.
  • Phishing, social engineering, impersonation, credential theft, or other fraudulent schemes designed to deceive individuals or organizations.
  • Money laundering, concealment of criminal proceeds, terrorist financing, or violations of applicable Anti-Money Laundering (AML) requirements.
  • Terrorism, terrorist activities, support, recruitment, financing, or assistance of criminal or prohibited organizations.
  • Human trafficking, exploitation, forced labor, slavery, or activities involving the exploitation of vulnerable persons.
  • Child sexual abuse material (CSAM), child exploitation, grooming, or any activity involving the sexual exploitation of minors.
  • Illegal gambling, betting operations, lottery services, or similar activities prohibited by applicable law.
  • The sale, distribution, promotion, or facilitation of illegal drugs, narcotics, controlled substances, or prohibited chemicals.
  • The unlawful sale, distribution, trafficking, or promotion of firearms, explosives, weapons, or regulated military equipment.
  • The sale, distribution, promotion, or operation involving counterfeit, stolen, fraudulent, or illegally obtained goods.
  • Copyright infringement, trademark infringement, software piracy, unauthorized distribution of protected intellectual property, or violation of third-party rights.
  • Fraudulent online stores, fake investment platforms, Ponzi schemes, pyramid schemes, cryptocurrency scams, or deceptive financial operations.
  • Websites, applications, or services designed to deceive, impersonate, defraud, manipulate, or mislead individuals or organizations.
  • Activities prohibited under applicable export controls, sanctions regulations, embargoes, trade restrictions, or similar legal requirements.

2.2 Cooperation with Authorities

Apex Thunder reserves the right to investigate actual, suspected, or reported unlawful activity and may cooperate with law enforcement agencies, regulatory authorities, courts, payment processors, domain registries, hosting providers, security providers, or other relevant third parties where Apex Thunder reasonably believes such cooperation is appropriate, necessary, or required.

Apex Thunder may disclose information, preserve records, restrict access, or take other actions in response to valid legal requests, security concerns, fraud prevention requirements, or protection of its Services, Customers, infrastructure, and business interests. Apex Thunder shall not be liable for disclosures or actions taken in good faith to satisfy legal, regulatory, or security obligations.

2.3 Immediate Enforcement

If Apex Thunder reasonably believes, in its sole discretion, that a Customer, account, website, server, domain, or Service is being used for illegal activity, suspected illegal activity, fraud, abuse, or activity that presents a risk to Apex Thunder, its Customers, infrastructure, or third parties, Apex Thunder may immediately suspend, restrict, disable, or terminate the affected Services without prior notice, without liability, and without obligation to provide refunds or credits where permitted under the Terms of Service.

Apex Thunder is not required to wait for a legal judgment, regulatory determination, or third-party confirmation before taking reasonable protective actions to safeguard its Services and operations.

3. Network Abuse

Customers must not use Apex Thunder Services in any manner that disrupts, degrades, interferes with, threatens, or creates an unreasonable risk to the security, availability, integrity, or performance of Apex Thunder infrastructure, other Customers, third-party systems, or Internet-connected services. Activities that generate abuse reports, security concerns, excessive resource consumption, or operational risk may result in enforcement actions at Apex Thunder's sole discretion.

3.1 Prohibited Network Activities

Customers may not engage in, facilitate, assist, or permit activities including, but not limited to:

  • Distributed Denial-of-Service (DDoS) attacks, participation in DDoS campaigns, or operation of infrastructure intended to perform or support such attacks.
  • Denial-of-Service (DoS) attacks against any system, network, application, or Service without explicit authorization.
  • Launching, coordinating, supporting, or facilitating attacks against Apex Thunder infrastructure or third-party systems.
  • Unauthorized port scanning, vulnerability scanning, network probing, reconnaissance, or security testing against systems not owned or controlled by the Customer.
  • Brute-force attacks, credential stuffing, password spraying, account enumeration, or attempts to bypass authentication controls.
  • ARP spoofing, DNS spoofing, IP spoofing, packet manipulation, or other techniques intended to bypass security mechanisms or conceal malicious activity.
  • Operating botnets, command-and-control (C2) infrastructure, malware communication systems, or platforms used to coordinate unauthorized activity.
  • Hosting, distributing, or providing access to attack tools intended for unauthorized, malicious, or abusive purposes.
  • Using Apex Thunder Services to relay, redirect, amplify, hide, or facilitate malicious network traffic.
  • Any activity intended to disrupt, overload, interfere with, degrade, or negatively impact the operation of another network, system, or online Service.

3.2 Unauthorized Network Access

Customers must not attempt to gain unauthorized access to networks, systems, devices, applications, services, or accounts belonging to Apex Thunder, other Customers, or third parties. Unauthorized testing, monitoring, interception, exploitation, security assessment, or circumvention of security controls is prohibited unless expressly authorized by the system owner or approved in writing by Apex Thunder.

3.3 Open Proxies, VPNs & Relay Services

Customers may not operate open proxies, anonymous proxy services, unsecured VPN gateways, open mail relays, or similar relay infrastructure that enables abuse, spam, fraud, malicious traffic, unauthorized access, or concealment of prohibited activity.

Lawful proxy, VPN, or private networking deployments may be permitted where properly configured, secured, monitored, and operated in compliance with this Policy, the Terms of Service, and applicable laws. Apex Thunder reserves the right to restrict or suspend such Services where they create security risks, abuse complaints, or operational concerns.

3.4 Network Integrity

Customers are responsible for maintaining reasonable security controls over their applications, servers, configurations, and network services. If Customer-controlled systems become compromised, vulnerable, misconfigured, or involved in abusive activity, Apex Thunder may take protective actions including traffic restriction, isolation, suspension, or temporary limitation of affected Services until the issue has been addressed.

Apex Thunder is not required to determine the original cause of a compromise before taking reasonable measures necessary to protect its infrastructure, Customers, providers, or third parties.

3.5 Enforcement

Apex Thunder may implement protective measures including traffic filtering, rate limiting, bandwidth restrictions, temporary suspension, emergency mitigation, null routing, Service isolation, blocking of network activity, or termination of Services where Apex Thunder reasonably determines such action is necessary to protect its infrastructure, Customers, upstream providers, or Internet stability.

Such actions may be taken immediately, without prior notice where necessary, and do not create any obligation for Apex Thunder to provide refunds, credits, restoration of access, or compensation unless expressly required under applicable law or a separate written agreement.

4. Security Violations

Customers must not attempt to compromise, bypass, weaken, interfere with, or otherwise undermine the security of Apex Thunder Services, other Customers, third-party systems, or Internet-connected resources. Any unauthorized activity that threatens security, confidentiality, availability, or integrity of systems or data may result in enforcement actions at Apex Thunder's sole discretion.

4.1 Unauthorized Access

Customers may not access, attempt to access, facilitate access to, or assist any person in accessing accounts, servers, applications, databases, networks, APIs, control panels, systems, or resources without proper authorization from the owner of the system or Apex Thunder where applicable.

4.2 Circumvention of Security Controls

Customers may not bypass, disable, evade, reverse engineer, interfere with, or attempt to defeat authentication mechanisms, firewalls, access controls, security monitoring systems, rate limits, licensing protections, abuse prevention mechanisms, or any other technical safeguards implemented by Apex Thunder or third parties.

4.3 Exploitation of Vulnerabilities

Customers may not exploit vulnerabilities, security weaknesses, configuration errors, software defects, or previously unknown vulnerabilities for unauthorized access, disruption, data extraction, personal benefit, or any other prohibited purpose.

Customers who discover potential vulnerabilities affecting Apex Thunder infrastructure or Services should report them through appropriate support channels and must not exploit, publicly disclose, sell, distribute, or use such information in a manner that may create security risks.

4.4 Credential Theft

Customers may not collect, obtain, purchase, sell, distribute, store, misuse, or attempt to acquire usernames, passwords, authentication tokens, API keys, encryption keys, session cookies, or other credentials belonging to another person, organization, or system without proper authorization.

4.5 Interception & Surveillance

Customers may not intercept, monitor, capture, record, decrypt, alter, or manipulate communications, network traffic, systems, accounts, or data belonging to others without lawful authority and appropriate authorization.

4.6 Security Research

Security testing, vulnerability assessments, penetration testing, scanning, or similar activities involving Apex Thunder infrastructure, networks, or systems may only be performed with Apex Thunder's prior written authorization.

Customers may perform security testing on their own hosted applications, systems, and resources where they have full ownership or authorization to do so, provided that such activities do not impact Apex Thunder infrastructure, other Customers, third parties, or violate this Policy.

4.7 Compromised Services

Customers are responsible for maintaining appropriate security measures for their hosted environments, applications, accounts, credentials, and configurations. If Apex Thunder reasonably believes that a Service has been compromised, abused, vulnerable, or poses a security risk to Apex Thunder, other Customers, third parties, or network operations, Apex Thunder may isolate, restrict, suspend, or terminate the affected Service.

Apex Thunder may take protective action without first determining the source, cause, or responsible party behind a compromise. Customers must take reasonable steps to investigate, remediate, and prevent recurrence of security incidents affecting their Services.

5. Malware & Harmful Software

Apex Thunder Services may not be used to create, host, upload, distribute, execute, install, control, facilitate, or support the operation of malware, malicious software, harmful code, or any technology intended to compromise systems, data, networks, or users. Customers are solely responsible for ensuring that their websites, applications, servers, software, and hosted content remain secure and do not create risks to Apex Thunder, other Customers, or third parties.

5.1 Prohibited Malicious Software

Customers may not use Apex Thunder Services to develop, host, distribute, execute, control, or facilitate malicious software or harmful code, including, but not limited to:

  • Viruses, worms, trojans, ransomware, spyware, adware, rootkits, keyloggers, backdoors, or similar malicious programs.
  • Botnets, command-and-control (C2) infrastructure, malware loaders, droppers, exploit kits, or systems used to manage malicious activity.
  • Cryptojacking software, unauthorized cryptocurrency mining malware, or tools designed to consume computing resources without authorization.
  • Software designed to steal credentials, payment information, authentication data, personal information, or other sensitive information.
  • Software intended to disable security protections, evade detection, bypass access controls, or facilitate unauthorized access.
  • Any code, script, application, or mechanism intended to compromise, damage, disrupt, or gain unauthorized control over systems or networks.

5.2 Malware Distribution

Customers may not use Apex Thunder Services to distribute, deliver, host, redirect, mirror, store, or otherwise make available malicious software, infected files, harmful scripts, exploit packages, malicious downloads, or compromised content through websites, email services, APIs, file storage, repositories, applications, or any other method.

5.3 Compromised Websites & Applications

Customers are responsible for maintaining the security of their websites, applications, databases, plugins, themes, extensions, scripts, server configurations, and third-party software.

Websites, applications, servers, or Services that become compromised, infected, exploited, or used to distribute malware, phishing pages, malicious redirects, spam, unauthorized software, or harmful content may be restricted, isolated, suspended, or otherwise managed by Apex Thunder at its sole discretion until the security issue has been addressed.

5.4 Customer Security Responsibilities

Customers should maintain updated software versions, apply security patches, use appropriate authentication methods, monitor their hosted environments, maintain backups, and implement reasonable security practices to reduce the risk of compromise or abuse.

Apex Thunder does not guarantee detection, prevention, or removal of all malware, vulnerabilities, security threats, or malicious activity affecting Customer-controlled environments. Apex Thunder may perform security checks, malware scanning, or protective monitoring at its sole discretion, but such actions do not create any obligation to continuously monitor Customer Services.

5.5 Protective Actions

Where malicious activity is detected, reported, or reasonably suspected, Apex Thunder may take protective measures including isolating affected Services, restricting network access, blocking malicious traffic, removing or disabling harmful content where appropriate, requesting Customer remediation, or suspending or terminating affected Services in accordance with the Terms of Service.

Apex Thunder does not guarantee preservation, recovery, restoration, or availability of affected data during malware investigation, cleanup, isolation, or remediation activities. Removal of malware or correction of a security issue does not require Apex Thunder to restore Services if additional violations, risks, or policy concerns remain.

6. Spam & Unsolicited Communications

Apex Thunder maintains a strict policy against spam, unsolicited communications, abusive messaging practices, and activities that may negatively affect email reputation, network integrity, or third-party systems. Customers must use email and communication Services responsibly and in compliance with applicable laws, regulations, industry standards, and this Acceptable Use Policy.

6.1 Prohibited Spam Activities

Customers may not use Apex Thunder Services to send, relay, distribute, host, facilitate, or support unsolicited, deceptive, abusive, or unauthorized communications, including, but not limited to:

  • Unsolicited bulk email (UBE), unsolicited commercial email (UCE), or similar mass communications.
  • Mass email campaigns sent without appropriate recipient consent where consent is required under applicable law.
  • Email harvesting, address scraping, automated collection of email addresses, or unauthorized acquisition of contact information.
  • Purchased, rented, scraped, exchanged, or third-party mailing lists that lack lawful permission or documented consent.
  • Spam distributed through websites, contact forms, live chat systems, forums, applications, social media integrations, or automated communication tools.
  • SMS spam, messaging platform spam, push notification spam, automated unsolicited messages, or similar communication abuse.
  • Affiliate spam, referral spam, comment spam, forum spam, review manipulation, or reputation abuse.

6.2 Email Integrity

Customers must not falsify, forge, hide, or manipulate email headers, sender identities, routing information, domain ownership information, authentication records, or other message metadata.

The use of deceptive subject lines, forged sender addresses, spoofed domains, misleading content, or any technique intended to conceal the true origin, sender, or purpose of communications is prohibited.

6.3 Blacklists & Reputation

Customers must not engage in activities that cause or may reasonably be expected to cause Apex Thunder IP addresses, domains, mail servers, or network resources to be placed on spam blocklists, reputation databases, abuse lists, or similar monitoring services.

Customers responsible for excessive complaints, abnormal sending patterns, high bounce rates, compromised mail accounts, blacklist listings, or damage to email reputation may be required to immediately take corrective action or may have affected Services restricted, suspended, or terminated.

6.4 Mailing List Requirements

Mailing lists must be permission-based and managed in accordance with applicable legal requirements. Customers are responsible for maintaining appropriate records of consent where required, providing functional unsubscribe mechanisms, and honoring unsubscribe requests within legally required or commercially reasonable timeframes.

Apex Thunder does not verify or guarantee the legality of Customer mailing practices and Customers remain solely responsible for their subscriber lists, consent records, campaigns, and communications.

6.5 Email Delivery & Reputation

Apex Thunder does not guarantee email delivery, inbox placement, acceptance by third-party providers, or uninterrupted access to email Services. External providers may independently filter, block, delay, reject, or classify messages according to their own policies and systems.

6.6 Enforcement

Apex Thunder may restrict, throttle, disable, suspend, or terminate email functionality, outgoing mail capabilities, domains, accounts, or affected Services where spam, abusive messaging, reputation risks, or related violations are detected, reported, or reasonably suspected.

Customers may be required to investigate, remediate, and resolve the underlying issue before restoration of affected Services. Suspensions or restrictions resulting from spam violations do not create any obligation for Apex Thunder to provide refunds, credits, compensation, or immediate restoration of access.

7. Resource Abuse

Apex Thunder Services must be used in a responsible manner that does not negatively affect the availability, security, stability, performance, or operation of Apex Thunder infrastructure, other Customers, or third-party services. Customers may not consume, reserve, monopolize, or misuse system resources in a manner that creates operational impact or unreasonable risk.

7.1 Excessive Resource Consumption

Customers may not intentionally, negligently, or through improper configuration consume excessive amounts of CPU, memory, storage, disk I/O, database resources, network bandwidth, connections, processes, or other computing resources in a manner that disrupts, degrades, or threatens the operation of Apex Thunder Services or other Customers.

Apex Thunder reserves the right to determine whether resource usage is excessive, abusive, abnormal, or harmful based on actual system impact, operational requirements, usage patterns, and the overall stability of the platform.

7.2 Cryptocurrency Mining & Intensive Computing

Cryptocurrency mining, cryptojacking, blockchain mining, proof-of-work operations, mining pools, mining proxies, unauthorized GPU workloads, distributed computing activities, or similar resource-intensive operations are prohibited unless expressly authorized by Apex Thunder in writing for a specific Service.

7.3 Automated Abuse

Customers may not deploy automated scripts, bots, crawlers, schedulers, or other software that generates excessive requests, unnecessary traffic, abusive activity, or unreasonable system load.

Legitimate automation, APIs, monitoring tools, and scheduled tasks are permitted where properly configured, responsibly operated, and where they do not negatively affect Apex Thunder infrastructure or other Customers.

7.4 Infinite Processes & Resource Exhaustion

Customers may not intentionally create or operate infinite loops, runaway processes, fork bombs, uncontrolled background tasks, recursive operations, memory exhaustion processes, or workloads designed to consume excessive resources, reduce availability, or interfere with normal Service operation.

7.5 File Storage Abuse

Hosting Services may not be used primarily as file storage systems, backup repositories, archival platforms, media distribution systems, file-sharing platforms, or content delivery networks unless the purchased Service is specifically intended and marketed for such purposes.

Customers are responsible for maintaining their own backups and recovery procedures. Apex Thunder Services, including any backup features that may be offered, should not be considered a replacement for Customer-controlled backup solutions unless expressly stated in a separate written agreement.

7.6 Fair Use

Customers must operate their Services consistently with reasonable usage expectations for the purchased Service. Fair Use determinations are based on actual resource impact, infrastructure requirements, operational conditions, and the effect on other Customers.

Activities that materially interfere with other Customers, create security or performance risks, or place an unreasonable burden on Apex Thunder infrastructure may require corrective action, resource restrictions, Service changes, upgrades, suspension, or other appropriate measures.

7.7 Corrective Measures

Where excessive, abusive, or harmful resource consumption is detected or reasonably suspected, Apex Thunder may implement temporary resource limitations, restrict affected processes, isolate workloads, request Customer remediation, recommend migration to a more suitable Service, suspend affected Services, or take other reasonable actions necessary to protect platform stability.

Such actions do not create any obligation for Apex Thunder to provide refunds, credits, compensation, or restoration of unrestricted resource access.

8. Content Restrictions

Customers are solely responsible for all content uploaded, stored, hosted, published, transmitted, displayed, or otherwise made available through Apex Thunder Services. Apex Thunder does not routinely monitor Customer content and has no obligation to do so, but reserves the right to review, restrict, remove, or take action regarding content where necessary to protect its Services, Customers, infrastructure, third parties, or comply with legal and policy requirements.

8.1 Prohibited Content

Customers may not host, upload, publish, distribute, transmit, link to, facilitate, or otherwise make available content including, but not limited to:

  • Illegal, fraudulent, deceptive, or intentionally misleading content.
  • Content promoting terrorism, violent extremism, organized crime, criminal activity, or unlawful conduct.
  • Child sexual abuse material (CSAM), child exploitation content, or any material involving the abuse or exploitation of minors.
  • Content that infringes or facilitates infringement of copyrights, trademarks, patents, trade secrets, or other intellectual property rights.
  • Counterfeit goods, fraudulent documents, forged identities, fake credentials, or deceptive certifications.
  • Phishing websites, fake authentication pages, impersonation services, fraudulent platforms, or deceptive online operations.
  • Malware, malicious scripts, exploit tools, harmful downloads, or content designed to compromise systems or users.
  • Content intended to facilitate hacking, unauthorized access, cyber abuse, or prohibited technical activities.
  • Knowingly unlawful defamatory, libelous, or maliciously false content intended to unlawfully harm another person's rights or reputation.
  • Content that unlawfully violates privacy rights, personal information protections, or other legally protected interests.
  • Any other content prohibited by applicable law, court order, or enforceable legal requirement.

8.2 AI-Generated Content

AI-generated content is permitted where used responsibly and in compliance with applicable laws and this Policy. Customers may not use Apex Thunder Services to generate, host, publish, distribute, or facilitate AI-generated content used for fraud, impersonation, phishing, malware creation, unlawful deepfakes, unauthorized identity simulation, harmful deception, or other abusive activities.

8.3 User Responsibility

Customers remain solely responsible for reviewing, managing, moderating, and ensuring the legality, accuracy, and appropriateness of content made available through their Services, including content submitted by employees, contractors, website visitors, users, customers, community members, affiliates, or other third parties.

Customers operating platforms that allow third-party submissions, uploads, comments, forums, marketplaces, or user-generated content are responsible for implementing appropriate controls, moderation processes, and abuse prevention measures.

Apex Thunder is not responsible for Customer content and does not assume liability for content created, uploaded, or distributed by Customers or their users.

8.4 Content Removal

Apex Thunder reserves the right, at its sole discretion, to restrict access to, disable, quarantine, remove, or otherwise limit availability of content where reasonably necessary to comply with applicable laws, respond to legal requests, address security risks, prevent abuse, protect infrastructure, protect Customers or third parties, or enforce this Policy and the Terms of Service.

Apex Thunder is not obligated to review, investigate, or provide advance notice before taking action where immediate action is reasonably necessary. Where appropriate and practical, Customers may be provided an opportunity to correct, remove, or remediate affected content before additional enforcement measures are taken.

Content removal, restriction, or disabling of access does not create any liability, refund obligation, credit entitlement, or duty to restore the affected content or Service.

Apex Thunder respects intellectual property rights and expects Customers to respect the rights of Apex Thunder and third parties. Customers may not use Apex Thunder Services to infringe, facilitate infringement of, misappropriate, or otherwise violate copyrights, trademarks, patents, trade secrets, or other intellectual property rights.

9.1 Intellectual Property Infringement

Customers may not host, upload, publish, distribute, reproduce, transmit, sell, link to, or otherwise make available any material that infringes, allegedly infringes, or facilitates infringement of copyrights, trademarks, patents, trade secrets, database rights, design rights, or other intellectual property rights protected under applicable law.

9.2 Unauthorized Distribution

Customers may not use Apex Thunder Services to distribute, host, promote, provide access to, or facilitate the distribution of pirated software, cracked applications, license bypass tools, unauthorized activation systems, stolen digital products, counterfeit software, or other materials that violate intellectual property rights.

9.3 Trademark Misuse

Customers may not use the names, trademarks, logos, branding elements, domain names, identifiers, or other marks belonging to Apex Thunder or third parties in a manner that is unauthorized, misleading, deceptive, likely to cause confusion, or that falsely suggests sponsorship, endorsement, partnership, ownership, or affiliation.

9.4 Removal of Proprietary Notices

Customers may not remove, modify, hide, falsify, or interfere with copyright notices, trademark notices, licensing information, ownership statements, digital rights management information, attribution requirements, or other proprietary notices associated with software, content, products, or digital assets.

9.5 Customer Responsibility

Customers are solely responsible for ensuring that they possess all required rights, licenses, permissions, consents, and authorizations necessary to host, publish, distribute, modify, use, or otherwise make available any content, software, databases, media, designs, themes, plugins, applications, or other materials through Apex Thunder Services.

Apex Thunder does not verify ownership, licensing status, or authorization for Customer-provided materials and Customers remain solely responsible for any claims arising from their use of such materials.

9.6 Intellectual Property Complaints

Apex Thunder may review notices, complaints, reports, or claims alleging intellectual property infringement and may take actions it considers appropriate, including restricting access to, disabling, removing, or suspending affected content, accounts, domains, or Services where reasonably necessary to comply with legal requirements, protect rights holders, prevent abuse, or enforce this Policy.

Apex Thunder may request information, documentation, licenses, ownership evidence, or other materials from Customers before restoring affected content or Services. Apex Thunder is not required to determine the ultimate validity of a dispute before taking reasonable protective actions.

Repeated, intentional, or serious intellectual property violations may result in permanent termination of affected Services without liability or obligation to restore access.

10. Email Services

Apex Thunder provides email services for legitimate communications and business operations. Customers are solely responsible for configuring, securing, and using email services in a manner that protects the reputation, reliability, and security of Apex Thunder infrastructure and complies with this Acceptable Use Policy. Apex Thunder does not guarantee email delivery, inbox placement, acceptance by third-party providers, or uninterrupted email availability.

10.1 Responsible Use

Customers must use email services responsibly and may not engage in activities that impair, threaten, or negatively affect the deliverability, availability, security, reputation, or operation of Apex Thunder email infrastructure, domains, IP addresses, or other Customers' Services.

10.2 Email Security

Customers are responsible for protecting their email accounts, mailboxes, authentication credentials, SMTP settings, email-enabled applications, integrations, and connected systems.

Customers should use strong passwords, enable multi-factor authentication where available, maintain updated software, and implement reasonable security measures to reduce unauthorized access, compromise, and abuse.

10.3 Email Authentication

Customers should implement appropriate email authentication technologies, including SPF, DKIM, and DMARC where supported, to improve sender verification, reduce spoofing risks, and assist with email reputation management.

Proper email authentication does not guarantee delivery, inbox placement, acceptance by receiving providers, or avoidance of spam filtering by third-party email platforms.

10.4 Open Relays & Mail Server Misconfiguration

Customers may not operate open mail relays, unsecured mail services, unauthorized forwarding systems, or configurations that permit abuse, unauthorized message delivery, spam distribution, or malicious email activity.

Customers are responsible for ensuring that their email configurations, applications, scripts, and integrations do not create risks to Apex Thunder infrastructure or third parties.

10.5 Reputation Protection

Customers must promptly investigate and resolve compromised email accounts, excessive sending activity, abnormal bounce rates, abuse complaints, malware infections, unauthorized access, or other conditions that may negatively affect Apex Thunder IP addresses, domains, mail servers, or email reputation.

10.6 Email Limitations

Apex Thunder may apply reasonable limits related to email transmission volume, message rates, mailbox storage, attachments, connections, authentication requirements, or other operational parameters to protect platform stability, prevent abuse, and maintain service reliability.

Such limits may vary based on Service type, Customer usage patterns, security considerations, infrastructure requirements, or third-party provider requirements and may be modified from time to time without prior notice where reasonably necessary.

10.7 Email Deliverability

Apex Thunder does not control third-party email providers, filtering systems, reputation databases, recipient policies, or external security mechanisms. Messages may be delayed, rejected, filtered, blocked, or delivered to spam folders by third-party providers.

10.8 Enforcement

Where email services are used in violation of this Policy, generate abuse reports, threaten platform reputation, or present security or operational risks, Apex Thunder may restrict outgoing mail, suspend affected email accounts, disable email functionality, require corrective action, or take other reasonable protective measures necessary to protect its infrastructure and Customers.

Such restrictions may be applied immediately where necessary and do not create any obligation for Apex Thunder to provide refunds, credits, compensation, immediate restoration, or guaranteed recovery of email functionality.

11. Domains & DNS Services

Apex Thunder provides domain registration support, DNS management, and related services to assist Customers with operating their online services. Customers are solely responsible for ensuring that their domains, DNS records, and related configurations are used lawfully, securely, and in compliance with this Acceptable Use Policy, applicable laws, and third-party registry requirements.

11.1 Responsible Use of Domains

Customers may not register, transfer, configure, maintain, or use domain names for unlawful, fraudulent, deceptive, abusive, or malicious purposes. Domains may not be used to facilitate activities that violate this Policy, applicable law, intellectual property rights, or the rights of others.

11.2 DNS Abuse

Customers may not use Apex Thunder DNS Services, delegated DNS configurations, or domain-related services to facilitate malware distribution, phishing operations, malicious redirects, command-and-control infrastructure, DNS tunneling, fast-flux networks, domain generation algorithms (DGA), DNS amplification attacks, cache poisoning, or other malicious DNS-related activities.

11.3 Domain Impersonation

Customers may not register, configure, or use domain names intended to impersonate individuals, organizations, brands, government entities, financial institutions, or other third parties for fraud, phishing, identity theft, deception, unlawful gain, or user confusion.

This includes, but is not limited to, deceptive look-alike domains, typo-squatting, misleading variations of legitimate domains, or domain names created to falsely suggest affiliation or authorization.

11.4 DNS Security

Customers are responsible for maintaining accurate DNS records, protecting domain credentials, and securing DNS configurations. Customers must promptly correct DNS settings that create security risks, service disruption, abuse conditions, or unintended exposure of systems.

Apex Thunder is not responsible for outages, misrouting, security issues, or service interruptions caused by incorrect Customer DNS configurations, expired domains, third-party DNS providers, or Customer-managed settings.

11.5 Third-Party Registry Policies

Domain registrations, renewals, transfers, and related Services are subject to the rules, policies, requirements, dispute procedures, and enforcement actions of applicable domain registries, registrars, ICANN where applicable, and other governing organizations.

Customers are responsible for maintaining accurate registration information, meeting renewal requirements, and complying with all applicable domain registration obligations. Apex Thunder is not responsible for domain suspension, cancellation, expiration, transfer restrictions, or loss resulting from Customer actions, registry actions, third-party decisions, or failure to maintain compliance.

11.6 Suspension of Domain or DNS Services

Apex Thunder may temporarily suspend, restrict, disable, modify, or remove access to domain-related Services, DNS configurations, records, or associated features where reasonably necessary to prevent abuse, protect infrastructure, protect Customers or third parties, comply with legal obligations, enforce this Policy, or respond to verified security incidents or lawful requests.

Where urgent circumstances exist, Apex Thunder may take protective action without prior notice. Such actions do not create liability, refund obligations, compensation requirements, or any guarantee of restoration.

12. VPS & Dedicated Servers

Apex Thunder provides Customers with administrative-level access and control over Cloud VPS Hosting and Dedicated Servers. Such flexibility requires Customers to assume full responsibility for server administration, security, configuration, applications, and all activities conducted through their environments. Customers must ensure that their servers comply with this Acceptable Use Policy, the Terms of Service, and applicable laws.

12.1 Customer Responsibility

Customers are solely responsible for the administration, configuration, maintenance, security, and operation of their VPS or Dedicated Server environments, including operating systems, installed software, applications, databases, websites, user accounts, credentials, firewall rules, network services, and hosted content.

Apex Thunder is not responsible for data loss, security breaches, unauthorized access, downtime, configuration errors, software failures, or damages resulting from Customer actions, Customer-managed systems, installed applications, or failure to maintain appropriate security practices.

12.2 Server Security

Customers must implement reasonable security measures appropriate for their server environment, including applying security updates, maintaining supported software versions, securing administrative credentials, configuring access controls, using appropriate firewall protections, monitoring systems, and addressing vulnerabilities in a timely manner.

Unless expressly included in a separate Managed Service agreement, Apex Thunder does not continuously monitor, audit, secure, or administer Customer-managed servers on the Customer's behalf.

12.3 Prohibited Server Activities

Customers may not use VPS or Dedicated Servers to operate, host, facilitate, or support activities including, but not limited to:

  • Botnets, command-and-control (C2) infrastructure, malware distribution, or malicious automation systems.
  • Cryptocurrency mining, cryptojacking, mining pools, mining proxies, or similar resource-intensive activities without prior written authorization from Apex Thunder.
  • DDoS attacks, attack infrastructure, stress testing services, booters, attack relays, or traffic amplification systems.
  • Open proxies, unauthorized relay services, anonymous proxy networks, or VPN services designed to facilitate abuse or conceal malicious activity.
  • Unauthorized penetration testing, vulnerability scanning, exploitation attempts, or attacks against third-party systems.
  • Spam infrastructure, bulk unsolicited email systems, fraudulent platforms, phishing websites, illegal marketplaces, or prohibited content distribution.
  • Any activity that materially threatens, disrupts, degrades, or interferes with Apex Thunder infrastructure, upstream providers, third parties, or other Customers.

12.4 Compromised Servers

Customers are responsible for promptly investigating, containing, and remediating compromised servers, unauthorized access, malware infections, security incidents, or abuse originating from their environments.

Where a VPS or Dedicated Server is reasonably suspected of participating in malicious activity or creating a significant security, operational, or reputational risk, Apex Thunder may isolate, restrict, suspend, filter, or disconnect the affected Service until the issue has been addressed.

Customers must cooperate with reasonable security requests, provide necessary information, and take corrective actions required to restore safe operation.

12.5 Managed Services

Unless expressly stated in the applicable Service description or a separate written agreement, Cloud VPS Hosting and Dedicated Servers are provided as self-managed Services.

Customers remain responsible for system administration, software updates, security hardening, backups, monitoring, application management, and operational maintenance of their environments.

Apex Thunder does not provide backup, disaster recovery, security management, or server administration services unless specifically purchased or included in a separate Managed Service arrangement.

12.6 Emergency Actions

Where immediate action is reasonably necessary to protect Apex Thunder infrastructure, Customers, upstream providers, network stability, or third parties, Apex Thunder may implement emergency measures including traffic filtering, rate limiting, network restrictions, service isolation, suspension, or disconnection.

Emergency actions may be taken without prior notice where delay could increase risk or harm. Apex Thunder will take reasonable steps to limit such actions to what is necessary to address the identified issue.

Such actions do not create liability, compensation obligations, refund rights, or any obligation to restore unrestricted access until security and operational concerns have been resolved.

13. Reporting Abuse

Apex Thunder provides reporting channels for Customers, security researchers, rights holders, network operators, and other affected parties to submit suspected violations of this Acceptable Use Policy. Apex Thunder may review submitted reports in good faith and determine appropriate actions based on available information, severity of the reported activity, applicable laws, operational considerations, and business requirements.

13.1 Reporting Suspected Abuse

Abuse reports should include sufficient information to assist Apex Thunder in evaluating the reported activity, including where available, affected domain names, IP addresses, URLs, service identifiers, timestamps, logs, screenshots, technical details, supporting documentation, or other relevant evidence.

Submission of a report does not establish that a violation has occurred. Apex Thunder may request additional information, clarification, or evidence before taking any action.

13.2 Investigation Process

Apex Thunder may review reports individually and may request additional information from the reporting party or the Customer associated with the reported activity.

During any review, Apex Thunder may preserve relevant information, restrict access to affected Services, apply temporary protective measures, or take other reasonable actions necessary to protect infrastructure, Customers, third parties, or comply with legal obligations.

Apex Thunder does not guarantee any specific investigation timeline, outcome, or resolution process.

13.3 False or Malicious Reports

Abuse reporting channels must not be used to harass Customers, damage reputations, interfere with legitimate business operations, target competitors, submit automated complaints without reasonable basis, or knowingly provide false, misleading, or incomplete information.

Apex Thunder may disregard unsupported reports and may take appropriate action against individuals or organizations that misuse abuse reporting mechanisms, including restricting access to reporting channels or pursuing available remedies where appropriate.

13.4 Customer Cooperation

Customers are expected to reasonably cooperate with abuse reviews by responding to legitimate requests for information, investigating reported issues, implementing appropriate corrective actions, and taking reasonable measures to prevent recurring violations.

Failure to provide reasonable cooperation, ignoring abuse notifications, or failing to address confirmed issues may result in enforcement actions under this Policy or the Terms of Service.

13.5 No Obligation to Disclose Investigations

To protect confidentiality, security, legal obligations, internal processes, and the integrity of investigations, Apex Thunder is not required to disclose investigation methods, internal assessments, evidence reviews, communications with reporting parties, actions taken regarding other Customers, or enforcement decisions.

Apex Thunder may limit disclosures where required to protect privacy, security interests, confidential information, legal privilege, or the rights of Customers and third parties.

14. Enforcement Actions

Apex Thunder reserves the right to investigate suspected violations of this Acceptable Use Policy and take appropriate enforcement actions where reasonably necessary to protect Customers, infrastructure, business operations, third parties, or comply with applicable laws and legal obligations. Enforcement decisions may consider the nature, severity, frequency, duration, impact, and overall risk associated with the reported activity.

14.1 Available Enforcement Measures

Depending on the circumstances and applicable requirements, Apex Thunder may take one or more of the following actions:

  • Issue warnings, notices, or requests for corrective action.
  • Require removal, correction, or remediation of prohibited content, configurations, or activities.
  • Restrict specific features, Services, accounts, credentials, or network access.
  • Apply security controls, traffic filtering, rate limitations, or resource restrictions.
  • Disable, quarantine, remove, or restrict access to affected content or resources.
  • Preserve relevant technical information, logs, or evidence where reasonably necessary.
  • Temporarily suspend, isolate, disconnect, or restrict affected Services.
  • Permanently terminate Services, accounts, or future access to Apex Thunder platforms.
  • Refuse future orders, registrations, or additional Services.
  • Take any other reasonable action necessary to protect Apex Thunder, Customers, third parties, or infrastructure.

14.2 Immediate Suspension

Apex Thunder may suspend, isolate, restrict, or terminate Services without prior notice where we reasonably determine that immediate action is necessary to prevent ongoing abuse, protect infrastructure, address security risks, comply with legal obligations, reduce potential harm, or protect Customers and third parties.

Emergency enforcement actions do not create liability, refund obligations, compensation rights, or any guarantee of immediate restoration of affected Services.

14.3 Repeat Violations

Repeated violations, recurring abuse complaints, patterns of prohibited activity, unresolved security issues, or failure to implement reasonable corrective actions may result in progressively stronger enforcement measures, including permanent suspension or termination of affected Services or Customer accounts.

14.4 No Right to a Warning

Apex Thunder may provide warnings or opportunities to correct certain violations where appropriate, but Customers are not entitled to receive advance notice, warnings, or remediation periods before enforcement action is taken.

Serious, intentional, malicious, illegal, security-related, or high-risk violations may result in immediate action without prior notification.

14.5 No Refund for Policy Violations

Where Services are suspended, restricted, or terminated due to violations of this Acceptable Use Policy, the Terms of Service, or other Apex Thunder policies, Customers are not entitled to refunds, credits, compensation, or reimbursement except where required by applicable law.

Enforcement actions resulting from Customer violations do not qualify for SLA credits, service guarantees, or other compensation remedies, except where such exclusion is prohibited by applicable law or a separate written agreement.

14.6 Cooperation with Authorities

Where required by applicable law, court order, regulatory requirement, or valid legal process, Apex Thunder may preserve relevant records and cooperate with law enforcement agencies, courts, regulatory authorities, registries, registrars, payment providers, and other competent organizations investigating suspected unlawful or abusive activities.

14.7 Reservation of Rights

The enforcement actions described in this Policy are examples only and are not exhaustive. Apex Thunder reserves all rights, remedies, and protections available under applicable law, the Terms of Service, other legal policies, and applicable Customer agreements.

Any enforcement action taken by Apex Thunder does not limit its ability to pursue additional remedies, including legal action, recovery of damages, protection of its interests, or enforcement of other contractual rights.

15. Changes to This Policy

Apex Thunder may update, revise, modify, or replace this Acceptable Use Policy from time to time to reflect changes in our Services, operational requirements, security practices, legal obligations, industry standards, risk management considerations, or other legitimate business needs.

15.1 Right to Modify

Apex Thunder reserves the right to amend this Policy at any time where reasonably necessary to address changes in technology, emerging threats, security requirements, applicable laws, regulatory obligations, Service improvements, operational requirements, or other business considerations.

Updates may apply to existing Customers and Services unless otherwise stated in the revised version or prohibited by applicable law.

15.2 Effective Date

Unless otherwise specified, revisions to this Policy become effective on the Effective Date displayed at the beginning of this document or on the date otherwise communicated by Apex Thunder.

Continued access to or use of Apex Thunder Services after the effective date of any revision constitutes acceptance of the updated Policy, subject to any mandatory rights or requirements imposed by applicable law.

15.3 Customer Responsibility

Customers are responsible for periodically reviewing this Policy and remaining informed of the current requirements applicable to their use of Apex Thunder Services.

The latest version published by Apex Thunder supersedes all prior versions of this Policy unless a separate written agreement expressly provides otherwise.

15.4 Notice of Material Changes

Where required by applicable law, or where Apex Thunder determines it is appropriate, we may provide notice of material changes through the Apex Thunder website, Client Area, email communications, service announcements, or other reasonable communication methods.

Apex Thunder determines, in its reasonable discretion, whether a modification constitutes a material change requiring additional notice. Minor updates, clarifications, corrections, security-related changes, or operational adjustments may become effective without separate notification.
